1. Acknowledgement

This agreement is between you and Windsor Creative Labs only, and not with Apple, Inc. Windsor Creative Labs is solely responsible for the PawPulse application and its content.

2. Scope of License

We grant you a non-transferable license to use PawPulse on any Apple-branded products that you own or control as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This app may be accessed and used by other accounts via Family Sharing or volume purchasing.

3. Maintenance and Support

Windsor Creative Labs is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for PawPulse.

4. Warranty

Windsor Creative Labs is solely responsible for any product warranties, express or implied by law. In the event of any failure of PawPulse to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.

5. Product Claims

Windsor Creative Labs, not Apple, is responsible for addressing any claims relating to the App or your possession/use of the App, including: (i) product liability claims; (ii) claims that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

In the event of any third-party claim that PawPulse or your use of it infringes their intellectual property rights, Windsor Creative Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claims.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Service Description & AI Disclaimer

PawPulse uses AI to analyze dog videos for entertainment purposes only. These results, including "bark translations," are not professional veterinary advice. Always consult a qualified veterinarian for health concerns.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using PawPulse (for example, you must not be in violation of your wireless data service agreement while using the App).

10. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

• Account Information: When you create an account, we collect your Apple ID authentication credentials (we do not receive or store your Apple ID password).
• Dog Profile Information: Names, breeds, ages, and photos of your dogs that you choose to add.
• Video Content: Videos you upload for analysis. These are processed by our AI systems and are not permanently stored after analysis is complete.
• Text Descriptions: Any context or descriptions you provide about your dog's behavior.

Automatically Collected Information:

• Device Information: Device type, operating system version, and unique device identifiers.
• Usage Data: How you interact with the App, including features used and analysis history.

How We Use Your Information

• To provide and maintain the App's functionality
• To process video analyses and generate bark translations
• To manage your account and subscription
• To improve our AI analysis accuracy
• To communicate with you about updates or support

Data Processing and AI

Videos you submit are processed using third-party AI services (OpenAI and Google) to analyze your dog's behavior. These services process the video content solely to provide the analysis results. Videos are transmitted securely and are not retained by these services after processing.

Data Sharing

We do not sell your personal information. We may share information with:

• Service Providers: Third-party services that help us operate the App (AI processing, hosting, analytics)
• Payment Processors: Apple processes all subscription payments through the App Store
• Legal Requirements: When required by law or to protect our rights

Data Retention

• Video Content: Deleted immediately after analysis (not stored)
• Analysis Results: Stored in your account history until you delete them or your account
• Account Data: Retained until you delete your account

Your Rights

You have the right to:

• Access your personal data
• Delete your account and associated data
• Export your analysis history
• Opt out of non-essential communications

Children's Privacy

The App is not intended for children under 13. We do not knowingly collect information from children under 13. If you believe we have collected such information, please contact us immediately.

Security

We implement industry-standard security measures to protect your data, including encryption in transit and at rest. However, no method of transmission over the internet is 100% secure.
